D\u00f6nem Milletvekili Genel Se\u00e7imlerinden sonra Anayasada yap\u0131lan (y\u00f6netim reformu) de\u011fi\u015fiklik ile Cumhurba\u015fkanl\u0131\u011f\u0131 h\u00fck\u00fcmet sistemine ge\u00e7ilmi\u015ftir. B\u00f6ylece \u00fclkemizde siyasal anlamda k\u00f6kl\u00fc bir de\u011fi\u015fiklik meydana gelmi\u015ftir. \u00dclkelerde olu\u015fan siyasal anlamda k\u00f6kl\u00fc de\u011fi\u015fiklikler genel bir bar\u0131\u015fmay\u0131 da gerekli k\u0131lmaktad\u0131r.<\/p>\n<p>\u00dclkemizde y\u0131llar i\u00e7inde meydana gelen sosyal ve ekonomik de\u011fi\u015fiklikler, zaman i\u00e7inde ekonomik yap\u0131n\u0131n yozla\u015fmas\u0131, gelir adaletsizli\u011finin yol a\u00e7t\u0131\u011f\u0131 yoksulluk ve ahlaki de\u011ferlerde a\u015f\u0131nman\u0131n yan\u0131 s\u0131ra, sa\u011fl\u0131ks\u0131z kentle\u015fme, i\u015fsizlik, \u00fccret, enflasyon, ki\u015fi ba\u015f\u0131na d\u00fc\u015fen gelir gibi makroekonomik de\u011fi\u015fkenler ve yaz\u0131l\u0131, g\u00f6rsel ve dijital yay\u0131nlar ile sosyal payla\u015f\u0131m sitelerindeki \u015fiddet \u00f6\u011feleri, su\u00e7lar\u0131n artmas\u0131na yol a\u00e7m\u0131\u015ft\u0131r.<\/p>\n<p>Bilindi\u011fi \u00fczere; FET\u00d6\/PDY mensubu h\u00e2kim ve savc\u0131lar, ge\u00e7mi\u015fte adalet mekanizmas\u0131 ve adalet duygusunda derin yaralar a\u00e7m\u0131\u015flard\u0131r. Kanun teklifinin ama\u00e7lar\u0131ndan biri, bu derin yaralar\u0131n onar\u0131lmas\u0131n\u0131 sa\u011flamakt\u0131r. Hain FET\u00d6\/PDY \u00f6rg\u00fct\u00fcn\u00fcn, adalet sistemimiz i\u00e7erisindeki yapm\u0131\u015f oldu\u011fu kadrola\u015fman\u0131n sa\u011flad\u0131\u011f\u0131 avantajla siyasi, ideolojik ve ekonomik olarak has\u0131m g\u00f6rd\u00fc\u011f\u00fc ki\u015fileri, hukuk g\u00f6r\u00fcn\u00fcml\u00fc ancak hukuk d\u0131\u015f\u0131 y\u00f6ntemlerle tasfiye, cezaland\u0131rma ve yok etme yollar\u0131na ba\u015fvurdu\u011fu bir hakikattir.<\/p>\n<p>FET\u00d6\/PDY \u00f6rg\u00fct\u00fc \u00fcyesi h\u00e2kim ve savc\u0131lar, \u00f6rg\u00fct\u00fcn stratejisi do\u011frultusunda bulunduklar\u0131 konumlar\u0131n\u0131 silah olarak kullanm\u0131\u015flard\u0131r. Ama\u00e7 ve hedefleri do\u011frultusunda \u00f6rg\u00fcte, tam bir ba\u011fl\u0131l\u0131k ve itaatle hareket eden h\u00e2kimlik ve savc\u0131l\u0131k vasf\u0131n\u0131 kaybetmi\u015f bu ki\u015filer, vermi\u015f olduklar\u0131 kararlar ile y\u00fcz binlerce insan\u0131m\u0131za telafisi m\u00fcmk\u00fcn olmayan ma\u011fduriyetler ya\u015fatm\u0131\u015flard\u0131r.<\/p>\n<p>Keza \u00f6rg\u00fct \u00fcyelerinin performans y\u00fckselmesini sa\u011flamak i\u00e7in su\u00e7la m\u00fccadele ad\u0131 alt\u0131nda sahte raporlar, yalan tan\u0131klar ve usuls\u00fcz dinlemeler ile binlerce ki\u015fiyi tutuklam\u0131\u015flard\u0131r.<\/p>\n<p>\u00d6rg\u00fct\u00fcn hukuk sitemini kullanarak ger\u00e7ekle\u015ftirdi\u011fi haks\u0131zl\u0131klar ve ma\u011fduriyetlerin, \u201cyarg\u0131laman\u0131n yenilenmesi ve di\u011fer kanun yollar\u0131yla\u201d giderilmesi de hukuken m\u00fcmk\u00fcn olmam\u0131\u015ft\u0131r.<\/p>\n<p>Bunun sonucu olarak, \u00f6rg\u00fct hiyerar\u015fisine tabi h\u00e2kim ve savc\u0131lar\u0131n, 2006-2016 y\u0131llar\u0131 aras\u0131nda vermi\u015f olduklar\u0131 hukuka ayk\u0131r\u0131 kararlar ve usuls\u00fcz tutuklamalar ile tutuklu ve h\u00fck\u00fcml\u00fc say\u0131s\u0131nda \u00fclkemizin d\u00fcnyada yedinci, Avrupa\u2019da birinci s\u0131rada yer almas\u0131na neden olmu\u015flard\u0131r.<\/p>\n<p>Cezaevleri, teorik olarak toplumun genel g\u00fcvenli\u011fini sa\u011flamak i\u00e7in vard\u0131r. Bununla birlikte cezaevleri, h\u00fck\u00fcml\u00fc ve tutuklular\u0131n \u0131slah ve rehabilite s\u00fcre\u00e7lerinin tamamlanarak topluma yeniden kazand\u0131r\u0131lmas\u0131n\u0131 sa\u011flayan kurumlard\u0131r.<\/p>\n<p>G\u00fcn\u00fcm\u00fczde cezaevlerindeki fiziki ko\u015fullar olduk\u00e7a yetersiz olup su\u00e7luyu \u0131slah ve rehabilite ederek topluma yeniden kazand\u0131rma i\u015flevini h\u0131zla kaybetti\u011fi g\u00f6r\u00fclmektedir. Cezaevi ko\u011fu\u015flar\u0131n\u0131n kapasitesinin \u00fc\u00e7 d\u00f6rt kat\u0131 ki\u015fiyi bar\u0131nd\u0131rmas\u0131, kurum b\u00fcnyesinde g\u00fcven zafiyeti olu\u015fturmaktad\u0131r.<br \/>\nBir ki\u015finin tutuklu ya da h\u00fck\u00fcml\u00fc olmas\u0131, onun insan haklar\u0131ndan mahrum olaca\u011f\u0131 anlam\u0131na gelmez.<\/p>\n<p>Cezaevlerindeki tutuklu ve h\u00fck\u00fcml\u00fcler yetersizlik sebebiyle n\u00f6betle\u015fe uyumaktad\u0131r. Mahk\u00fbmlara sa\u011flanan bar\u0131nma olanaklar\u0131, \u00f6zellikle uyuma yerleri, gerekli hava hacmine ve asgari alana sahip de\u011fildir. Devlet, \u00f6zg\u00fcrl\u00fc\u011f\u00fc elinden al\u0131nm\u0131\u015f ki\u015filerin sa\u011fl\u0131\u011f\u0131ndan sorumludur.<\/p>\n<p>Bug\u00fcn itibariyle \u00fclkemizde bulunan 449 cezaevinin kapasitesi 211.274 \u2018t\u00fcr. Cezaevlerimizde 194.404 h\u00fck\u00fcml\u00fc, 59.131 tutuklu olmak \u00fczere, toplam 253.535 ki\u015fi bulunmaktad\u0131r. Fiziki yetersizlikler, sosyal bar\u0131\u015f\u0131 tehdit edebilecek nitelikte olup provokasyonlara a\u00e7\u0131k haldedir.<\/p>\n<p>Yasama organ\u0131n\u0131n, ceza hukuku ile tamamlay\u0131c\u0131s\u0131 olan infaz hukuku alan\u0131nda baz\u0131 fiillerin su\u00e7 olarak tan\u0131mlanmas\u0131 veya su\u00e7 olmaktan \u00e7\u0131kar\u0131lmas\u0131, cezalar\u0131n yerine getirilme ko\u015fullar\u0131n\u0131n belirlenmesi konular\u0131nda kamu yarar\u0131n\u0131 g\u00f6zeterek d\u00fczenlemeler yapma takdir hak ve yetkisi bulunmaktad\u0131r.<\/p>\n<p>Ancak kullan\u0131lan bu yetkinin, Anayasa, evrensel hukuk kurallar\u0131 ve \u00fclkemizin taraf oldu\u011fu s\u00f6zle\u015fmeler ile uyumlu olmas\u0131 esast\u0131r.<\/p>\n<p>Cezaevleri ve infaz hukuku ile ilgili yeni bir d\u00fczenleme yapmak, af \u00e7\u0131karmak, cezalarda indirim yap\u0131lmak suretiyle bu sorunlar\u0131 \u00e7\u00f6zmek ad\u0131na olu\u015fan fikir ve s\u00f6ylemler, 2018 May\u0131s ay\u0131 ortalar\u0131nda toplumun tamam\u0131 ile payla\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Cumhuriyetimizin kurucusu Gazi Mustafa Kemal Atat\u00fcrk\u2019\u00fcn Samsun\u2019a \u00e7\u0131k\u0131\u015f\u0131 ve Milli Hareketi ba\u015flatma tarihi olan \u201c19 May\u0131s\u201d g\u00fcn\u00fc bu sebeple esas al\u0131narak 19 May\u0131s 2018 tarihinden sonra i\u015flenen su\u00e7lar kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Bu d\u00fczenlemede, Anayasan\u0131n ba\u015flang\u0131\u00e7 k\u0131sm\u0131nda yaz\u0131l\u0131 oldu\u011fu \u015fekilde; \u201chi\u00e7bir faaliyet, T\u00fcrk milli menfaatlerinin, T\u00fcrk varl\u0131\u011f\u0131n\u0131n, Devleti ve \u00fclkesiyle b\u00f6l\u00fcnmezli\u011fi esas\u0131n\u0131n, T\u00fcrkl\u00fc\u011f\u00fcn tarihi ve manevi de\u011ferlerinin kar\u015f\u0131s\u0131nda korunma g\u00f6remez\u201d h\u00fckm\u00fc esas al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Adalet sistemimiz i\u00e7inde olu\u015fan haks\u0131zl\u0131k ve ma\u011fduriyetlerin k\u0131smen de olsa giderilmesi ile h\u00fck\u00fcml\u00fc ve tutuklular\u0131n topluma yeniden kazand\u0131r\u0131lmas\u0131, toplumsal bar\u0131\u015f ve uzla\u015fmay\u0131 sa\u011flamak ama\u00e7lanm\u0131\u015ft\u0131r.<\/p>\n<p>Anayasa\u2019n\u0131n 10 uncu maddesinde d\u00fczenlenen e\u015fitlik ilkesi gere\u011fi, hukuksal durumlar\u0131 ayn\u0131 olan ki\u015filerin yasalar kar\u015f\u0131s\u0131nda ayn\u0131 i\u015fleme ba\u011fl\u0131 tutulmas\u0131 g\u00f6zetilerek, belli su\u00e7lara ili\u015fkin tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken cezalardan indirim yap\u0131lmas\u0131 uygun g\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>MADDE GEREK\u00c7ELER\u0130<br \/>\nMadde 1- \u201cAma\u00e7\u201d ba\u015fl\u0131kl\u0131 madde ile Kanun\u2019un 3 \u00fcnc\u00fc maddesinde g\u00f6sterilen ve ayr\u0131k tutulanlar haricinde 19 May\u0131s 2018 tarihine kadar i\u015flenen su\u00e7lar y\u00f6n\u00fcnden, tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken toplam cezadan \u015fartl\u0131 indirim yap\u0131lmas\u0131 ve bunun sonucu olarak infaz\u0131 gereken cezas\u0131 kalmayan h\u00fck\u00fcml\u00fc ve tutuklular\u0131n sal\u0131verilmesi d\u00fc\u015f\u00fcn\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n<p>Madde 2- Bu maddeyle istisna ba\u015fl\u0131\u011f\u0131nda say\u0131lm\u0131\u015f olan su\u00e7lar\u0131n d\u0131\u015f\u0131ndaki su\u00e7larla ilgili olarak h\u00fck\u00fcml\u00fclerin, tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmeleri gereken toplam ceza s\u00fcresinden bir defaya mahsus olmak \u00fczere be\u015f y\u0131l indirim yap\u0131lmas\u0131 d\u00fczenlenmi\u015ftir.<\/p>\n<p>Maddeye g\u00f6re kesinle\u015fmi\u015f h\u00fck\u00fcmlerde, h\u00fck\u00fcml\u00fc olanlar\u0131n tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmeleri gereken toplam ceza s\u00fcresinden be\u015f y\u0131l indirilecektir. H\u00fck\u00fcml\u00fcn\u00fcn birden fazla cezas\u0131 olmas\u0131 halinde indirim, her bir ceza i\u00e7in ayr\u0131 ayr\u0131 uygulanmayacak ve tabi olunan infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken toplam cezadan bir defaya mahsus olmak \u00fczere yap\u0131lacakt\u0131r. Be\u015f y\u0131l indirim yap\u0131ld\u0131ktan sonra infaz\u0131 gereken ceza kalmamas\u0131 durumunda h\u00fck\u00fcml\u00fc sal\u0131verilecektir.<\/p>\n<p>Buna ba\u011fl\u0131 olarak soru\u015fturma ve kovu\u015fturma evresindeki dosyalarda tutuklu bulunanlar ile istinaf ve temyiz kanun yolu a\u015famalar\u0131ndaki dosyalarda tutuklu bulunan \u015f\u00fcpheli veya san\u0131klar\u0131n tutukluluk durumlar\u0131n\u0131n de\u011ferlendirilmesi hususlar\u0131 d\u00fczenlenmi\u015ftir.<\/p>\n<p>\u0130stinaf ve temyiz kanun yolunda bulunan dosyalarda, san\u0131k hakk\u0131nda ilk derece mahkemesi ile \u0130stinaf Ceza Dairesi\u2019nce h\u00fckmolunan cezalar\u0131n toplam s\u00fcresi g\u00f6zetilerek, tabi olunacak infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken toplam ceza s\u00fcresinden yap\u0131lacak be\u015f y\u0131l indirim de hesaplanmak suretiyle tutukluluk durumu konusunda bir karar verilir.<\/p>\n<p>Yarg\u0131tay Ceza Dairesi\u2019nce, \u0130stinaf Ceza Dairesi veya \u0130lk Derece Mahkemesi\u2019nin, \u0130stinaf Ceza Dairesi\u2019nce de, \u0130lk Derece Mahkemesi\u2019nin mahk\u00fbmiyetine ili\u015fkin san\u0131\u011f\u0131n tabi oldu\u011fu infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmesi gereken toplam ceza s\u00fcresi g\u00f6z \u00f6n\u00fcne al\u0131nacakt\u0131r. San\u0131k hakk\u0131ndaki mahk\u00fbmiyet d\u0131\u015f\u0131ndaki kararlar ile su\u00e7un nitelik de\u011fi\u015ftirme olas\u0131l\u0131\u011f\u0131, cezalardaki art\u0131r\u0131m ve indirim nedenleri bu a\u015famada irdelenmeyecektir.<\/p>\n<p>San\u0131k hakk\u0131nda birden fazla su\u00e7la ilgili mahk\u00fbmiyet kararlar\u0131nda, t\u00fcm su\u00e7lara ili\u015fkin cezalar\u0131n tabi oldu\u011fu infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken toplam ceza s\u00fcresi \u00fczerinden bir defaya mahsus yap\u0131lacak be\u015f y\u0131l indirim sonucu tutukluluk durumu de\u011ferlendirilerek karar verilecektir.<\/p>\n<p>Kovu\u015fturma a\u015famas\u0131ndaki dosyalarda ise, iddianame ya da g\u00f6revsizlik karar\u0131nda san\u0131\u011f\u0131n i\u015fledi\u011fi iddia olunan su\u00e7 veya su\u00e7lar\u0131n t\u00fcm\u00fc y\u00f6n\u00fcnden uygulanmas\u0131 istenilen kanun maddesindeki cezalar\u0131n alt s\u0131n\u0131r\u0131 esas al\u0131narak tabi olunan infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken toplam ceza s\u00fcresi \u00fczerinden be\u015f y\u0131l indirim hesaplanmak suretiyle CMK\u2019n\u0131n 104 ve devam\u0131 maddeleri gere\u011fince san\u0131\u011f\u0131n tutukluluk durumunun devam\u0131na veya sal\u0131verilmesine karar verilecektir.<\/p>\n<p>Bu a\u015famada, san\u0131k hakk\u0131nda birden fazla su\u00e7tan dava a\u00e7\u0131lm\u0131\u015f olmas\u0131 durumunda, t\u00fcm su\u00e7lara ili\u015fkin kanun maddelerinde g\u00f6sterilen cezalar\u0131n alt s\u0131n\u0131r\u0131 esas al\u0131narak tabi oldu\u011fu infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmesi gereken toplam ceza s\u00fcresi \u00fczerinden bir defaya mahsus olmak \u00fczere be\u015f y\u0131l indirim yap\u0131ld\u0131ktan sonra san\u0131\u011f\u0131n tutukluluk durumu de\u011ferlendirilecektir.<\/p>\n<p>Su\u00e7un vas\u0131f ve mahiyetinin de\u011fi\u015fme ihtimali g\u00f6z \u00f6n\u00fcne al\u0131nmayacak ancak; te\u015febb\u00fcs, i\u015ftirak, zincirleme su\u00e7, haks\u0131z tahrik, ya\u015f k\u00fc\u00e7\u00fckl\u00fc\u011f\u00fc, ak\u0131l hastal\u0131\u011f\u0131 ve cezadan indirim yap\u0131lmas\u0131n\u0131 gerektiren \u015fahsi sebeplere ili\u015fkin h\u00fck\u00fcmler, tutukluluk halinin de\u011ferlendirilmesinde dikkate al\u0131nacakt\u0131r.<br \/>\nSoru\u015fturma evresinde ise, \u015f\u00fcphelinin \u00fczerine at\u0131l\u0131 su\u00e7 veya su\u00e7lar\u0131n t\u00fcm\u00fc g\u00f6z \u00f6n\u00fcne al\u0131narak, \u015f\u00fcphelinin i\u015fledi\u011fi iddia olunan su\u00e7lar\u0131n kanun maddelerindeki cezan\u0131n alt s\u0131n\u0131r\u0131 esas al\u0131nmak ve tabi oldu\u011fu infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmesi gereken toplam ceza s\u00fcresi \u00fczerinden bir defaya mahsus olmak \u00fczere be\u015f y\u0131l indirim yap\u0131ld\u0131ktan sonra CMK\u2019n\u0131n 104 ve devam\u0131 maddeleri uyar\u0131nca \u015f\u00fcphelinin tutukluluk halinin devam\u0131 veya sal\u0131verilmesi hususunda karar verilecektir. Te\u015febb\u00fcs, i\u015ftirak, zincirleme su\u00e7, haks\u0131z tahrik, ya\u015f k\u00fc\u00e7\u00fckl\u00fc\u011f\u00fc, ak\u0131l hastal\u0131\u011f\u0131 ve cezadan indirim yap\u0131lmas\u0131n\u0131 gerektiren \u015fahsi sebepler tutukluluk durumu de\u011ferlendirilmesinde g\u00f6z \u00f6n\u00fcne al\u0131nacakt\u0131r.<\/p>\n<p>Tutukluluk durumunun de\u011ferlendirilmesinde, san\u0131k veya \u015f\u00fcphelinin tutukluluk halinin devam\u0131 veya sal\u0131verilmesinde 5275 say\u0131l\u0131 Ceza ve G\u00fcvenlik Tedbirlerinin \u0130nfaz\u0131 birinci babtaki \u201cDevletin \u015eahsiyetine Kar\u015f\u0131 C\u00fcr\u00fcmler\u201d ba\u015fl\u0131kl\u0131 b\u00f6l\u00fcmde yer alan ve bu Kanun\u2019un \u00fc\u00e7\u00fcnc\u00fc maddesinde istisna edilen su\u00e7lar ile 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun d\u00f6rd\u00fcnc\u00fc k\u0131s\u0131m, d\u00f6rt, be\u015f, alt\u0131 ve yedinci b\u00f6l\u00fcmlerinde yer alan su\u00e7lar ve 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu\u2019nda yer alan su\u00e7lar\u0131n t\u00fcm\u00fc do\u011frudan milletimizin birli\u011fine, \u00fclkemizin b\u00f6l\u00fcnmez b\u00fct\u00fcnl\u00fc\u011f\u00fcne y\u00f6nelik devletin g\u00fcvenli\u011fine kar\u015f\u0131 su\u00e7lardan olu\u015fmaktad\u0131r.<\/p>\n<p>Son birka\u00e7 y\u0131ld\u0131r \u00f6zellikle \u00fclkemizin g\u00fcney s\u0131n\u0131rlar\u0131ndaki \u00fclkelerde meydana gelen i\u00e7 kar\u0131\u015f\u0131kl\u0131klar, ortaya \u00e7\u0131kan \u00f6rg\u00fctler ve \u00fclkeler aras\u0131 \u00e7\u0131kar \u00e7at\u0131\u015fmalar\u0131, vatan\u0131m\u0131z\u0131 do\u011frudan etkilemekte ve bu sorunlar bug\u00fcn itibariyle de devam etmektedir. S\u0131n\u0131rlar\u0131m\u0131z d\u0131\u015f\u0131ndaki \u00e7at\u0131\u015fma ve kar\u0131\u015f\u0131kl\u0131\u011f\u0131 f\u0131rsat bilen ter\u00f6r \u00f6rg\u00fctleri ve gruplar\u0131n \u00fclkemiz i\u00e7inde kanl\u0131 eylemlerde bulundu\u011fu, bu faaliyetlerin t\u00fcm\u00fcn\u00fcn T\u00fcrkiye Cumhuriyeti Devleti\u2019nin g\u00fcvenli\u011fine y\u00f6nelik oldu\u011fu g\u00f6z \u00f6n\u00fcne al\u0131narak, 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanunu ile T\u00fcrk Ceza Kanunu\u2019nun belirtilen maddelerindeki su\u00e7lar kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun, dokuzuncu bab, \u201c\u015eah\u0131slara Kar\u015f\u0131 C\u00fcr\u00fcmler\u201d ba\u015fl\u0131\u011f\u0131ndaki, birinci fas\u0131lda d\u00fczenlenen \u201cAdam \u00d6ld\u00fcrmek C\u00fcr\u00fcmleri\u201d ba\u015fl\u0131\u011f\u0131nda yer alan 448, 449, 450 nci maddeleri ile 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun ikinci kitap, ikinci k\u0131s\u0131m, birinci b\u00f6l\u00fcmde d\u00fczenlenen \u201cKasten \u00d6ld\u00fcrme\u201d ba\u015fl\u0131kl\u0131, 81 inci maddesi ve \u201cNitelikli Haller\u201d ba\u015fl\u0131kl\u0131 82 nci maddesindeki su\u00e7lar ile korunmak istenen hukuksal yarar, ki\u015finin \u201chayat hakk\u0131d\u0131r\u201d. Hayat hakk\u0131, insan olman\u0131n ve di\u011fer insan haklar\u0131n\u0131n kullan\u0131lmas\u0131n\u0131n \u00f6n \u015fart\u0131d\u0131r. Devlet taraf\u0131ndan hayat hakk\u0131, yaln\u0131zca bireysel de\u011fil, ayn\u0131 zamanda toplumsal bir de\u011fer oldu\u011fu i\u00e7in korunmu\u015ftur. Hayat hakk\u0131na sald\u0131r\u0131, b\u00fct\u00fcn haklara sald\u0131r\u0131 anlam\u0131ndad\u0131r. Herkesin ya\u015fam hakk\u0131na sahip oldu\u011funu belirten Anayasa\u2019n\u0131n 17 nci maddesinin birinci f\u0131kras\u0131 ve Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi\u2019nin 2 nci maddesi, devlete, ki\u015filerin ya\u015fama hakk\u0131n\u0131 koruma ve \u00f6ld\u00fcrme fiillerini cezaland\u0131rma y\u00fck\u00fcml\u00fcl\u00fcklerini y\u00fcklemektedir. Bu sebeplerle belirtilen su\u00e7lar kapsam d\u0131\u015f\u0131 tutulmu\u015ftur.<\/p>\n<p>765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun sekizinci babtaki 414, 415, 416, 417, 418, 419, 420, 421 inci maddeleri ile 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun \u201cCinsel Dokunulmazl\u0131\u011fa Kar\u015f\u0131 Su\u00e7lar\u201d ba\u015fl\u0131kl\u0131 ikinci kitap, ikinci k\u0131s\u0131m alt\u0131nc\u0131 b\u00f6l\u00fcmde d\u00fczenlenen, 102 inci maddesindeki \u201cCinsel Sald\u0131r\u0131\u201d, 103 \u00fcnc\u00fc maddesindeki \u201c\u00c7ocuklar\u0131n Cinsel \u0130stismar\u0131\u201d, 104 \u00fcnc\u00fc maddesindeki \u201cRe\u015fit Olmayanla Cinsel \u0130li\u015fki\u201d, 105 inci maddesindeki \u201cCinsel Taciz\u201d su\u00e7lar\u0131, toplumun gelece\u011fini, ahlak ve aile d\u00fczenini bozmaktad\u0131r.<\/p>\n<p>Son y\u0131llarda cinsel dokunulmazl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7lar kitle ileti\u015fim ara\u00e7lar\u0131n\u0131n etkinli\u011fi ile birlikte daha g\u00f6r\u00fcn\u00fcr hale gelmi\u015ftir. T\u00fcrk toplumu, en b\u00fcy\u00fck infiali bu su\u00e7lar kar\u015f\u0131s\u0131nda g\u00f6stermekte olup cinsel dokunulmazl\u0131\u011fa kar\u015f\u0131 i\u015flenen su\u00e7lar hakk\u0131nda cezai yapt\u0131r\u0131mlar\u0131n daha da a\u011f\u0131rla\u015ft\u0131r\u0131lmas\u0131 konusunda beklenti i\u00e7indedir.<\/p>\n<p>T\u00fcrkiye Cumhuriyeti Devleti taraf\u0131ndan da onaylanm\u0131\u015f olan \u201cBirle\u015fmi\u015f Milletler \u00c7ocuk Haklar\u0131 S\u00f6zle\u015fmesi\u201d ve Anayasa\u2019n\u0131n 41 inci maddesi ile g\u00fcvence alt\u0131na al\u0131nan, T\u00fcrk aile yap\u0131s\u0131n\u0131n muhafazas\u0131 ve \u00e7ocuklar\u0131n istismar ve \u015fiddetten korunmas\u0131 hususundaki emredici h\u00fck\u00fcmler gere\u011fince s\u00f6z konusu su\u00e7lar kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 243, 245 ve 478 inci maddelerinde d\u00fczenlenen su\u00e7lar\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olan ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 94 ve 95 inci maddelerinde d\u00fczenlenen \u201c\u0130\u015fkence\u201d ve \u201cNeticesi Sebebiyle A\u011f\u0131rla\u015fm\u0131\u015f \u0130\u015fkence\u201d su\u00e7lar\u0131n\u0131n birer insanl\u0131k su\u00e7u olu\u015fu, taraf\u0131 oldu\u011fumuz Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesi ile Milletleraras\u0131 S\u00f6zle\u015fmelerde i\u015fkencenin yasak olu\u015fu, 10 \u015eubat 1984 tarihli \u201c\u0130\u015fkenceye ve Di\u011fer Zalimane, Gayriinsani veya K\u00fc\u00e7\u00fclt\u00fcc\u00fc Muamele veya Cezaya Kar\u015f\u0131 Birle\u015fmi\u015f Milletler S\u00f6zle\u015fmesi\u201d h\u00fck\u00fcmlerine g\u00f6re hi\u00e7bir hal ve \u015fartta i\u015fkencenin me\u015fru ve mazur g\u00f6sterilemeyece\u011fi h\u00fck\u00fcmleri do\u011frultusunda bu su\u00e7lar hari\u00e7 tutulmu\u015ftur. Keza T\u00fcrk Ceza Kanunu\u2019nun 96 nc\u0131 maddesinde tan\u0131mlanan \u201cEziyet\u201d su\u00e7u da, i\u015fkence su\u00e7u ile ayn\u0131 b\u00f6l\u00fcmde d\u00fczenlenmi\u015f olmas\u0131, niteli\u011fi itibariyle i\u015fkence su\u00e7uyla benzerlik g\u00f6stermesi ve de Anayasa\u2019n\u0131n 17 nci maddesinin 3 nc\u00fc f\u0131kras\u0131ndaki \u201cKimseye i\u015fkence ve eziyet yap\u0131lamaz; kimse insan haysiyetiyle ba\u011fda\u015fmayan bir cezaya veya muameleye tabi tutulamaz.\u201d h\u00fckm\u00fc kar\u015f\u0131s\u0131nda kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun \u201cUluslararas\u0131 Su\u00e7lar\u201d ba\u015fl\u0131kl\u0131 birinci b\u00f6l\u00fcm\u00fcnde yer alan 76 nc\u0131 maddesindeki \u201cSoyk\u0131r\u0131m\u201d, 77 nci maddesindeki \u201c\u0130nsanl\u0131\u011fa Kar\u015f\u0131 Su\u00e7lar\u201d ile bu iki madde ile ba\u011flant\u0131l\u0131 78 inci maddesindeki \u201c\u00d6rg\u00fct\u201d su\u00e7lar\u0131n\u0131n niteli\u011fi, ceza s\u00fcresi ve \u00fclkemizin taraf\u0131 oldu\u011fu bir k\u0131s\u0131m s\u00f6zle\u015fmelere uygun olarak kapsam d\u0131\u015f\u0131 tutulmu\u015ftur.<br \/>\n5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 90 \u0131nc\u0131 maddesinde d\u00fczenlenen \u201c\u0130nsan \u00dczerinde Deney\u201d ve 91 inci maddesinde d\u00fczenlenen \u201cOrgan veya Doku Ticareti\u201d su\u00e7lar\u0131nda korunan hukuksal de\u011ferin ki\u015finin v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fc olu\u015fu g\u00f6z \u00f6n\u00fcne al\u0131narak kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Mustafa Kemal Atat\u00fcrk, Cumhuriyetimizin kurucusu ve Milli Kurtulu\u015f Sava\u015f\u0131\u2019n\u0131n komutan\u0131d\u0131r. Anayasa\u2019n\u0131n amir h\u00fckm\u00fc gere\u011fi 6831 say\u0131l\u0131 Orman Kanunu\u2019na tabi su\u00e7lar kapsam d\u0131\u015f\u0131 b\u0131rak\u0131lm\u0131\u015ft\u0131r.<br \/>\n765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nda istisna tutulan maddeler ile 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nda istisna tutulan maddeler hari\u00e7, 765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu ve 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019ndaki su\u00e7lar ve \u00d6zel Kanunlar uyar\u0131nca verilmi\u015f hapis cezalar\u0131 kanun kapsam\u0131na al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Madde 4- Bu madde, tutuklu ve h\u00fck\u00fcml\u00fclerin sal\u0131verilme s\u00fcreleri ve sal\u0131verilmenin hangi merciler taraf\u0131ndan yap\u0131laca\u011f\u0131na ili\u015fkindir.<\/p>\n<p>Madde ile Kanun\u2019un y\u00fcr\u00fcrl\u00fc\u011fe girmesinden itibaren kanunun d\u00f6rd\u00fcnc\u00fc maddesinde belirtilen tutukluk durumu de\u011ferlendirmesi ve sal\u0131verilme i\u015flemleri gecikmeksizin yerine getirilir.<\/p>\n<p>Sal\u0131verilme i\u015flemleri, soru\u015fturma s\u00fcrecinde Cumhuriyet Savc\u0131s\u0131\u2019n\u0131n talebi \u00fczerine Sulh Ceza Hakimli\u011fi\u2019nce, kovu\u015fturma a\u015famas\u0131nda yarg\u0131laman\u0131n s\u00fcrd\u00fcr\u00fcld\u00fc\u011f\u00fc mahkemece dosya re\u2019sen ele al\u0131narak dosya \u00fczerinden yap\u0131lacak inceleme sonucu karar verilecektir.<br \/>\nYarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131\u2019nda bulunan dosyalar en k\u0131sa s\u00fcrede ilgili Yarg\u0131tay Ceza Dairesi\u2019ne g\u00f6nderilecektir.<br \/>\nDosyan\u0131n \u0130stinaf Ceza Dairesi, Yarg\u0131tay Ceza Dairesi veya Yarg\u0131tay Ceza Genel Kurulu\u2019nda bulunmas\u0131 durumunda; ilgili istinaf veya Yarg\u0131tay Ceza Dairesi ile Yarg\u0131tay Ceza Genel Kurulu taraf\u0131ndan derhal karar verilecektir.<\/p>\n<p>Kesinle\u015fmi\u015f h\u00fck\u00fcmlere ili\u015fkin cezalar y\u00f6n\u00fcnden ise, h\u00fckm\u00fc veren mahkemece sal\u0131verilme karar\u0131 verilecektir.<br \/>\nSal\u0131verilme i\u015flemlerine ili\u015fkin kararlar, dosya \u00fczerinden inceleme yap\u0131lmak suretiyle verilecektir.<\/p>\n<p>Madde 5- Bu madde ile Kanun h\u00fck\u00fcmleri uyar\u0131nca tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmeleri gereken toplam ceza s\u00fcresi \u00fczerinden bir defaya mahsus olmak \u00fczere be\u015f y\u0131l indirim yap\u0131larak sal\u0131verilen h\u00fck\u00fcml\u00fclerin, bihakk\u0131n tahliye tarihine kadar hapis cezas\u0131n\u0131 gerektiren kas\u0131tl\u0131 bir su\u00e7 i\u015flemeleri ve bu hapis cezas\u0131n\u0131n kesinle\u015fmesi halinde, \u00e7ekmeleri gereken cezalardan yap\u0131lan be\u015f y\u0131ll\u0131k indirimin geri al\u0131narak cezalar\u0131n infaz\u0131na devam olunur.<\/p>\n<p>Bu d\u00fczenleme ile bihakk\u0131n tahliye tarihine kadar i\u015flenen su\u00e7un kas\u0131tl\u0131 bir su\u00e7 olmas\u0131 ayn\u0131 zamanda hapis cezas\u0131n\u0131 gerektirmesi ve h\u00fckmolunan hapis cezas\u0131n\u0131n kesinle\u015fmesi \u015fart\u0131 aranm\u0131\u015ft\u0131r.<\/p>\n<p>Uygulamada yaln\u0131zca adli para cezas\u0131n\u0131 veya se\u00e7imlik olarak adli para cezas\u0131 gerektiren baz\u0131 cezalar\u0131n kesin nitelikte olup istinaf ve temyiz yasa yolunun kapal\u0131 olu\u015fu nedeniyle yarg\u0131sal denetim yap\u0131lma olana\u011f\u0131 bulunmamaktad\u0131r. Bu sebeple, bihakk\u0131n tahliye tarihine kadar i\u015flenen kas\u0131tl\u0131 bir su\u00e7un hapis cezas\u0131n\u0131 gerektirmesi ve mahk\u00fbmiyetin kesinle\u015fmesi esas al\u0131nm\u0131\u015ft\u0131r.<\/p>\n<p>Madde 6- Y\u00fcr\u00fcrl\u00fck maddesidir.<br \/>\nMadde 7- Y\u00fcr\u00fctme maddesidir.<\/p>\n<p>BAZI SU\u00c7LARLA \u0130LG\u0130L\u0130 CEZA S\u00dcRELER\u0130NDEN \u015eARTLI \u0130ND\u0130R\u0130M \u0130LE TUTUKLU VE H\u00dcK\u00dcML\u00dcLER\u0130N SALIVER\u0130LMES\u0130NE DA\u0130R KANUN TEKL\u0130F\u0130<\/p>\n<p>Ama\u00e7<br \/>\nMadde 1- (1) Bu Kanunun amac\u0131, 19 May\u0131s 2018 tarihi d\u00e2hil olmak \u00fczere bu tarihten \u00f6nce i\u015flenen, Kanunda ayr\u0131k tutulanlar hari\u00e7, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu ve 765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu ile \u00d6zel Kanunlardaki su\u00e7lar y\u00f6n\u00fcnden tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken toplam ceza s\u00fcrelerinden \u015fartl\u0131 indirim yap\u0131lmas\u0131 ve bunun sonucu olarak infaz\u0131 gereken cezas\u0131 kalmayan h\u00fck\u00fcml\u00fc ve tutuklular\u0131n sal\u0131verilmesidir.<\/p>\n<p>Kapsam<br \/>\nMadde 2- (1) Kanun kapsam\u0131ndaki su\u00e7lardan dolay\u0131 h\u00fck\u00fcml\u00fc veya tutuklu olanlar\u0131n; kesinle\u015fmi\u015f h\u00fck\u00fcmlerde, h\u00fckmolunan cezalar\u0131n toplam\u0131ndan, tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekilmesi gereken cezadan bir defaya mahsus olmak \u00fczere be\u015f y\u0131l indirilir. \u0130ndirim yap\u0131ld\u0131ktan sonra infaz\u0131 gereken ceza kalmamas\u0131 durumunda h\u00fck\u00fcml\u00fc sal\u0131verilir.<br \/>\n(2) San\u0131k veya \u015f\u00fcphelinin tutukluluk durumu;<br \/>\na) \u0130stinaf ve Temyiz kanun yolunda, \u0130lk Derece Mahkemesi ile \u0130stinaf Ceza Dairesi\u2019nce h\u00fckmolunan cezalar\u0131n toplam s\u00fcresi,<br \/>\nb) Kovu\u015fturma evresinde, iddianamede ya da g\u00f6revsizlik karar\u0131nda san\u0131\u011f\u0131n i\u015fledi\u011fi iddia olunan su\u00e7 ve su\u00e7lara ili\u015fkin sevk maddelerindeki cezan\u0131n alt s\u0131n\u0131r\u0131,<br \/>\nc) Soru\u015fturma evresinde \u015f\u00fcphelinin \u00fczerine at\u0131l\u0131 su\u00e7 veya su\u00e7lar\u0131n kanun maddelerinde g\u00f6sterilen cezan\u0131n alt s\u0131n\u0131r\u0131,<br \/>\ng\u00f6z \u00f6n\u00fcne al\u0131narak tabi olduklar\u0131 infaz h\u00fck\u00fcmlerine g\u00f6re \u00e7ekmeleri gereken toplam ceza s\u00fcresi \u00fczerinden bir defaya mahsus olmak \u00fczere be\u015f y\u0131l indirim yap\u0131lmak suretiyle de\u011ferlendirilir.<\/p>\n<p>Cezalar\u0131n alt s\u0131n\u0131rlar\u0131n\u0131n belirlenmesinde, 5237 say\u0131l\u0131 T\u00fcrk Ceza Kanunu\u2019nun 61 inci maddesindeki \u00f6l\u00e7\u00fctler esas al\u0131narak ve 61 inci maddenin 5 inci f\u0131kras\u0131 uyar\u0131nca te\u015febb\u00fcs, i\u015ftirak, zincirleme su\u00e7, haks\u0131z tahrik, ya\u015f k\u00fc\u00e7\u00fckl\u00fc\u011f\u00fc, ak\u0131l hastal\u0131\u011f\u0131 ve cezada indirim yap\u0131lmas\u0131n\u0131 gerektiren \u015fahsi sebepler g\u00f6z \u00f6n\u00fcnde bulundurulur.<\/p>\n<p>\u0130stisnalar<br \/>\nMadde 3- (1) Bu Kanun h\u00fck\u00fcmleri;<br \/>\na) 765 uyar\u0131nca sal\u0131verilme i\u015flemleri;<br \/>\na) Soru\u015fturma evresinde Cumhuriyet Savc\u0131s\u0131\u2019n\u0131n talebi \u00fczerine Sulh Ceza H\u00e2kimli\u011fi\u2019nce,<br \/>\nb) Kovu\u015fturma evresinde yarg\u0131laman\u0131n devam etti\u011fi Mahkemece,<br \/>\nc) Dosyan\u0131n \u0130stinaf Mahkemesi, Yarg\u0131tay ilgili Dairesi veya Yarg\u0131tay Ceza Genel Kurulu\u2019nda bulunmas\u0131 durumunda, \u0130stinaf Mahkemesi, Yarg\u0131tay Ceza Dairesi ve Yarg\u0131tay Ceza Genel Kurulu\u2019nca,<br \/>\nd) Kesinle\u015fmi\u015f h\u00fck\u00fcmlerde, mahk\u00fbmiyet h\u00fckm\u00fcn\u00fc veren mahkemece,<br \/>\nDosya \u00fczerinden inceleme yap\u0131larak derhal yerine getirilecektir.<br \/>\n(2) Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131\u2019nda bulunan dosyalar, inceleme yapmakla g\u00f6revli ilgili Yarg\u0131tay Ceza Dairesi\u2019ne g\u00f6nderilir.<\/p>\n<p>Ceza \u0130ndiriminin Geri Al\u0131nmas\u0131<br \/>\nMadde 5- (1) \u0130kinci madde h\u00fck\u00fcmleri uyar\u0131nca sal\u0131verilen h\u00fck\u00fcml\u00fclerin, bihakk\u0131n tahliye tarihine kadar hapis cezas\u0131n\u0131 gerektiren kas\u0131tl\u0131 bir su\u00e7 i\u015flemeleri ve bu hapis cezas\u0131n\u0131n kesinle\u015fmesi halinde, yap\u0131lan indirim geri al\u0131narak cezalar\u0131n infaz\u0131na ba\u015flan\u0131r.<\/p>\n<p>Y\u00fcr\u00fcrl\u00fck<br \/>\nMadde 6- (1) Bu Kanun yay\u0131m\u0131 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girer.<br \/>\nY\u00fcr\u00fctme<br \/>\nMadde 7- (1) Bu
