﻿{"id":4256,"date":"2020-07-17T19:22:03","date_gmt":"2020-07-17T16:22:03","guid":{"rendered":"http:\/\/www.mhphaber.com\/?p=4256"},"modified":"2020-07-17T19:33:33","modified_gmt":"2020-07-17T16:33:33","slug":"mhp-genel-baskan-yardimcisi-feti-yildiz-chp-tbmmde-kabul-edilen-kanunlarin-iptali-icin-aymye-basvurmayi-siyasi-bir-aliskanlik-haline-getirmistir","status":"publish","type":"post","link":"http:\/\/www.mhphaber.com\/?p=4256","title":{"rendered":"MHP Genel Ba\u015fkan Yard\u0131mc\u0131s\u0131 Feti Y\u0131ld\u0131z: CHP, TBMM&#8217;de kabul edilen kanunlar\u0131n iptali i\u00e7in AYM&#8217;ye ba\u015fvurmay\u0131 siyasi bir al\u0131\u015fkanl\u0131k haline getirmi\u015ftir."},"content":{"rendered":"\n<p><strong>Y\u0131ld\u0131z<\/strong>, &#8220;Avukatl\u0131k Kanunu&#8217;ndaki de\u011fi\u015fikli\u011fin iptal sebebi olarak ileri s\u00fcrm\u00fc\u015f olduklar\u0131, s\u00fcre bak\u0131m\u0131ndan, usul a\u00e7\u0131s\u0131ndan<strong>\u00a0i\u00e7t\u00fcz\u00fc\u011fe ayk\u0131r\u0131l\u0131k ve eksiklik s\u00f6z konusu de\u011fil<\/strong>dir.&#8221; ifadesini kulland\u0131.<\/p>\n\n\n\n<p>MHP Genel Ba\u015fkan Yard\u0131mc\u0131s\u0131 \u2013 \u0130stanbul Milletvekili Say\u0131n Feti YILDIZ\u2019\u0131n, CHP\u2019nin Avukatl\u0131k Kanunu\u2019ndaki De\u011fi\u015fikli\u011fin \u0130ptali \u0130\u00e7in Anayasa Mahkemesi\u2019ne M\u00fcracaat\u0131 hakk\u0131ndaki bas\u0131n a\u00e7\u0131klamas\u0131<\/p>\n\n\n\n<p>Avukatl\u0131k Kanununda yap\u0131lan de\u011fi\u015fiklik, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nde kabul edilmi\u015f ve 15 Temmuz 2020 tarihinde Resmi Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015ftir.<\/p>\n\n\n\n<p>Bu kanunla, Barolar ger\u00e7ek g\u00f6revlerine d\u00f6necek, Baro hizmetleri Avukatl\u0131k Kanunu\u2019ndaki d\u00fczenlemeler \u00e7er\u00e7evesinde daha etkin ve sa\u011fl\u0131kl\u0131 bir \u015fekilde y\u00fcr\u00fct\u00fclecektir.<\/p>\n\n\n\n<p>CHP, y\u00fcr\u00fcrl\u00fc\u011fe giren ve 28 maddeden ibaret Avukatl\u0131k Kanunu\u2019ndaki de\u011fi\u015fikli\u011fin, 21 maddesinin iptali i\u00e7in Anayasa Mahkemesi\u2019ne ba\u015fvurmu\u015ftur. \u015e\u00fcphesiz Anayasa\u2019n\u0131n 150. maddesinden ald\u0131\u011f\u0131 yetkiyle iptal davas\u0131 a\u00e7abilir. Ancak CHP, d\u00fczenlemenin Anayasa\u2019ya ayk\u0131r\u0131 olup olmad\u0131\u011f\u0131na bakmaks\u0131z\u0131n, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019nce kabul edilen kanunlar\u0131n iptali i\u00e7in Anayasa Mahkemesi\u2019ne ba\u015fvurmay\u0131 siyasi bir al\u0131\u015fkanl\u0131k haline getirmi\u015ftir. Bug\u00fcn, Anayasa Mahkemesi, CHP\u2019nin daha \u00f6nce y\u00fcr\u00fcrl\u00fc\u011fe giren infaz yasas\u0131n\u0131n \u015fekil y\u00f6n\u00fcnden iptali ve y\u00fcr\u00fcrl\u00fc\u011f\u00fcn durdurulmas\u0131 istemiyle yapt\u0131\u011f\u0131 ba\u015fvuruyu reddetmi\u015ftir.<\/p>\n\n\n\n<p>Bilindi\u011fi gibi, Anayasa Mahkemesi soyut ve somut norm denetimi yapar. Kanun teklifinin Adalet Komisyonu\u2019na getirilmesi s\u00fcrecinde, \u0130\u00e7t\u00fcz\u00fc\u011f\u00fcn 26. maddesinin emretti\u011fi, teklifin \u00fcyelere 48 saat \u00f6nceden tebli\u011f edilmesi kural\u0131na uyulmu\u015f olup, elektronik ilan panosunda da yay\u0131nlanm\u0131\u015ft\u0131r. \u00d6te yandan, Kanunlar Kararlar Zimmet Defterindeki tarih, saat ve imzalar ile CHP\u2019nin bu konudaki itirazlar\u0131, tutanak ve tebli\u011f \u015ferhleriyle uyumlu de\u011fildir. \u0130ptal sebebi olarak ileri s\u00fcrm\u00fc\u015f olduklar\u0131, s\u00fcre bak\u0131m\u0131ndan, usul a\u00e7\u0131s\u0131ndan i\u00e7t\u00fcz\u00fc\u011fe ayk\u0131r\u0131l\u0131k ve eksiklik s\u00f6z konusu de\u011fildir.<\/p>\n\n\n\n<p>Adalet Komisyonu toplant\u0131s\u0131, Meclisimizde mevcut olan en b\u00fcy\u00fck komisyon salonunda yap\u0131lm\u0131\u015ft\u0131r. \u0130lk g\u00fcn, CHP Genel Ba\u015fkan\u0131\u2019n\u0131n, milletvekillerine vermi\u015f oldu\u011fu talimat do\u011frultusunda olu\u015fan izdiham, i\u00e7inde bulundu\u011fumuz pandemi ortam\u0131nda ciddi riskler olu\u015fturmu\u015f, Komisyonda yap\u0131lan g\u00f6r\u00fc\u015fmeler, hukuk ve usulle ilgisi alakas\u0131 olmayan \u015fova d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p>G\u00f6r\u00fc\u015fmeler s\u0131ras\u0131nda 296 milletvekili konu\u015fma yapm\u0131\u015f, baz\u0131lar\u0131 g\u00f6r\u00fc\u015fmeleri uzatmak i\u00e7in eline ge\u00e7irdi\u011fi her t\u00fcrl\u00fc metni saatlerce okumu\u015ftur. \u00d6yle ki, s\u00f6yleyecek s\u00f6z kalmay\u0131nca ansiklopedi getirtip okumu\u015flard\u0131r. Bu manzara, Genel Kurul salonunda da benzer \u015fekilde devam etmi\u015ftir.<\/p>\n\n\n\n<p>Anayasa Mahkemesi\u2019nin bir\u00e7ok karar\u0131nda g\u00f6r\u00fcld\u00fc\u011f\u00fc gibi, hukuk devleti ilkesi, eylem ve i\u015flemleri hukuka uygun, insan haklar\u0131na sayg\u0131l\u0131, bu hak ve \u00f6zg\u00fcrl\u00fckleri koruyup g\u00fc\u00e7lendiren, her alanda adaletli bir hukuk d\u00fczeni kurup, bunu geli\u015ftirerek s\u00fcrd\u00fcren, Anayasa&#8217;ya ayk\u0131r\u0131 durum ve tutumlardan ka\u00e7\u0131nan, hukukun \u00fcst\u00fcn kurallar\u0131yla kendini ba\u011fl\u0131 sayan, yarg\u0131 denetimine a\u00e7\u0131k, yasalar\u0131n \u00fcst\u00fcnde yasa koyucunun da uymas\u0131 gereken temel hukuk ilkeleri ve Anayasa&#8217;n\u0131n bulundu\u011fu bilincinde olan devlettir.<\/p>\n\n\n\n<p>Baz\u0131 Barolar mevcut yap\u0131s\u0131yla bir siyasi partinin kontrol ve g\u00fcd\u00fcm\u00fcndeki kurulu\u015flara d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. Kanunda yap\u0131lan de\u011fi\u015fiklikte, demokratik hukuk devleti ilkesine herhangi bir ayk\u0131r\u0131l\u0131k s\u00f6z konusu de\u011fildir. D\u00fczenlemeyle avukatlar\u0131n adil olarak temsili sa\u011flanm\u0131\u015f, adaletsizlik ve keyfilik ortadan kald\u0131r\u0131lm\u0131\u015ft\u0131r. Y\u00fcr\u00fcrl\u00fc\u011fe giren yasan\u0131n demokratik hukuk devletine ayk\u0131r\u0131l\u0131\u011f\u0131 iddias\u0131 temelsizdir.<\/p>\n\n\n\n<p>Avukatl\u0131k Kanunu\u2019nda yap\u0131lan de\u011fi\u015fiklik, ba\u011f\u0131ms\u0131z ve tarafs\u0131z yarg\u0131 yetkisine (Anayasa 9. mad.), Anayasa\u2019n\u0131n e\u015fitlik ilkesine (Anayasa 10. mad.), Anayasa\u2019n\u0131n ba\u011flay\u0131c\u0131l\u0131\u011f\u0131 ve \u00fcst\u00fcnl\u00fc\u011f\u00fc ilkesine (Anayasa 11. mad.) ayk\u0131r\u0131 herhangi bir unsur ta\u015f\u0131mamaktad\u0131r.<\/p>\n\n\n\n<p>Kamu kurumu niteli\u011findeki meslek te\u015fekk\u00fcllerinin hukuki dayana\u011f\u0131 olan Anayasa\u2019n\u0131n 135. maddesi, bu yap\u0131lar\u0131 ama\u00e7 d\u0131\u015f\u0131 faaliyetten a\u00e7\u0131k\u00e7a men etmi\u015f, idari ve mali denetimin d\u0131\u015f\u0131nda b\u0131rakmam\u0131\u015f ve Anayasa\u2019n\u0131n 123. maddesinde d\u00fczenlenen kamu t\u00fczelki\u015fili\u011fine ait tekel yetkisini vermemi\u015ftir. Kamu kurumu niteli\u011findeki meslek te\u015fekk\u00fcllerinin kurumsal yap\u0131s\u0131yla ilgili de\u011fi\u015fikliklerin kanunla yap\u0131lamayaca\u011f\u0131, ancak ilgili Anayasa maddesinin de\u011fi\u015ftirilmesi suretiyle yap\u0131laca\u011f\u0131 iddias\u0131, hata de\u011filse bir siyasi partiye yak\u0131\u015fmayacak ciddi bir bilgisizliktir.<\/p>\n\n\n\n<p>Kanunun uygulama s\u00fcresi bak\u0131m\u0131ndan Se\u00e7im Kanunu\u2019na at\u0131f yap\u0131lmas\u0131, de\u011fi\u015fikli\u011fin bir y\u0131l sonra uygulamaya ge\u00e7ebilece\u011fi iddias\u0131, Barolarla siyasi partileri birbirine kar\u0131\u015ft\u0131rmakt\u0131r.<\/p>\n\n\n\n<p>Barolar Birli\u011fi se\u00e7imleri i\u00e7in g\u00f6nderilecek delege say\u0131s\u0131nda iddia edildi\u011fi gibi herhangi bir \u00f6l\u00e7\u00fcs\u00fczl\u00fck s\u00f6z konusu de\u011fildir. Barolar Birli\u011fi, avukatlar\u0131 de\u011fil, Birli\u011fi temsil eder. Baro se\u00e7imlerinde \u00e7o\u011funluk sistemi uygulanmaktad\u0131r. Burada herhangi bir ihtilaf yoktur. Yap\u0131lan de\u011fi\u015fiklikle temsilde adalet sa\u011flanm\u0131\u015ft\u0131r. Kanunun, temel hak ve h\u00fcrriyetlerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131na (Anayasa 13. mad.), se\u00e7me, se\u00e7ilme ve siyasi faaliyette bulunma haklar\u0131na (Anayasa 67. mad.) ayk\u0131r\u0131 oldu\u011fu iddialar\u0131 temelsizdir.<\/p>\n\n\n\n<p>CHP s\u00f6zc\u00fcleri, bu d\u00fczenleme ile iki bin avukat\u0131n bir araya gelerek, etnik, mezhepsel, ideolojik Baro kuracaklar\u0131 iddialar\u0131n\u0131 dile getirirken, \u00f6ncelikle i\u015fbirli\u011fi ve ortakl\u0131k yapt\u0131\u011f\u0131 partiler ve \u00f6rg\u00fctlere bakmal\u0131d\u0131r. \u0130zledikleri kin ve nefret siyaseti, kendilerine de, \u00dclkemize de, Milletimize de zarar vermektedir.<\/p>\n\n\n\n<p>T\u00fcrkiye Cumhuriyeti, demokratik, laik bir hukuk devletidir. Meslek \u00f6rg\u00fctlenmesi ad\u0131 alt\u0131nda yasad\u0131\u015f\u0131 hi\u00e7bir kurulu\u015f ve faaliyete seyirci kalmaz. Avukatl\u0131k Kanunu\u2019ndaki de\u011fi\u015fiklik teklifinin Meclis Ba\u015fkanl\u0131\u011f\u0131\u2019na sunulmas\u0131ndan itibaren CHP, adeta kanun h\u00e2kimiyeti sa\u011flanm\u0131\u015f kurtar\u0131lm\u0131\u015f b\u00f6lgelerdeki \u00f6rg\u00fct \u00fcyelerinin \u015fa\u015fk\u0131nl\u0131k ve pani\u011fini ya\u015famaktad\u0131r. CHP Grup Ba\u015fkanvekilinin Anayasa Mahkemesi\u2019ne vermi\u015f oldu\u011fu dilek\u00e7eden sonra yapt\u0131\u011f\u0131 bas\u0131n a\u00e7\u0131klamas\u0131nda; \u201cBu kanun y\u00fczde y\u00fcz iptal edilecektir\u201d s\u00f6zleri hukuki beklentiyi a\u015fmaktad\u0131r. Bu ve benzer beyanlar, Y\u00fcksek Mahkeme\u2019yi etkileyemeyecektir.
