Esasen Kurtulu\u015f Sava\u015f\u0131m\u0131z\u0131n strateji belgesidir. 1961 ve 1982 Anayasalar\u0131 askeri darbeler \u00fcr\u00fcn\u00fcd\u00fcr.&#8221;<\/strong>&nbsp;ifadelerini kullan\u0131rken \u015funlar\u0131 kaydetti;<\/p>\n\n\n\n<p>&#8220;T\u00fcrkiye\u2019de modernle\u015fme, bat\u0131dakinden farkl\u0131 bir \u015fekilde ortaya \u00e7\u0131km\u0131\u015ft\u0131r. Bat\u0131\u2019da modernle\u015fme, uzun bir geli\u015fim sonucu a\u015fa\u011f\u0131dan kitlenin geleneksel toplumu de\u011fi\u015ftirmesi \u015feklinde olmu\u015ftur. T\u00fcrkiye\u2019de ise devletin ve ayd\u0131n bir z\u00fcmrenin hareketi olarak yukar\u0131dan a\u015fa\u011f\u0131ya do\u011fru gelmi\u015ftir. Bu durum toplumsal ve siyasal geli\u015fmemizde siyasi darbe giri\u015fimlerinde ve buhranlar\u0131m\u0131zda b\u00fcy\u00fck rol oynam\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Anayasalar\u0131m\u0131z ve kanunlar\u0131m\u0131z\u0131n yap\u0131lmas\u0131 a\u015famalar\u0131nda bu ger\u00e7ek a\u00e7\u0131k\u00e7a g\u00f6r\u00fcl\u00fcr. 23 maddeden olu\u015fan 1921 Anayasas\u0131 klasik manada bir anayasa de\u011fildir. Esasen Kurtulu\u015f Sava\u015f\u0131m\u0131z\u0131n strateji belgesidir. 1961 ve 1982 Anayasalar\u0131 askeri darbeler \u00fcr\u00fcn\u00fcd\u00fcr.<\/p>\n\n\n\n<p>Anayasalar\u0131n temel iki i\u015flevi vard\u0131r: Birincisi, bireyin sahip oldu\u011fu temel hak ve \u00f6zg\u00fcrl\u00fckleri g\u00fcvence alt\u0131na almak, ikincisi, devlet te\u015fkilat\u0131n\u0131n otorite ve g\u00fcc\u00fcn\u00fcn s\u0131n\u0131rlar\u0131n\u0131 belirlemektir.<\/p>\n\n\n\n<p>\u0130svi\u00e7re\u2019den ald\u0131\u011f\u0131m\u0131z Medeni Kanun, Bor\u00e7lar Kanunu, \u0130talya\u2019dan ald\u0131\u011f\u0131m\u0131z Ceza Kanunu, Fransa\u2019dan ald\u0131\u011f\u0131m\u0131z \u0130dare Hukuku, yak\u0131n bir zamana kadar kelimesine dokunmadan y\u00fcr\u00fcrl\u00fckte kalm\u0131\u015ft\u0131r. Bu bile, modernle\u015fmenin yukar\u0131dan a\u015fa\u011f\u0131ya do\u011fru geldi\u011finin bariz g\u00f6stergesidir.<\/p>\n\n\n\n<p>Modern Demokrasiler; yasama, y\u00fcr\u00fctme, yarg\u0131 g\u00fc\u00e7lerinin ayr\u0131l\u0131\u011f\u0131na dayan\u0131r. Geleneksel tarihin do\u011frulad\u0131\u011f\u0131 \u0130bni Haldun; \u2018<em>\u2019Devleti Nesep kurar, sebep devam ettirir\u2019\u2019<\/em>&nbsp;derken buradaki sebebin adalet oldu\u011fu bilinir.<\/p>\n\n\n\n<p>Devletin temeli adalettir. Adaleti, T\u00fcrk Milleti ad\u0131na T\u00fcrk yarg\u0131s\u0131 tesis eder. Anayasan\u0131n 138. maddesinde yaz\u0131l\u0131 oldu\u011fu gibi;<\/p>\n\n\n\n<p>Hi\u00e7bir makam, mercii veya ki\u015fi, yarg\u0131 yetkisinin kullan\u0131lmas\u0131nda mahkemelere ve hakimlere emir ve talimat veremez, tavsiye ve telkinde bulunamaz. Kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesi; demokrasinin, hukuk devletinin, insan haklar\u0131n\u0131n teminat\u0131d\u0131r.<\/p>\n\n\n\n<p>T\u00fcrk adaleti Uzun bir zaman diliminde b\u00fcnyesine s\u0131zm\u0131\u015f hain bir yap\u0131lanmay\u0131 k\u0131sa s\u00fcrede s\u00f6k\u00fcp atm\u0131\u015ft\u0131r. Devletin k\u0131lcallar\u0131na kadar s\u0131zm\u0131\u015f bu ter\u00f6r \u00f6rg\u00fct\u00fc mensubu 99 bin ki\u015fi tutuklanm\u0131\u015ft\u0131r. Bu g\u00fcn itibariyle FET\u00d6\u2019den 22 bin 340 h\u00fck\u00fcml\u00fc ve tutuklu vard\u0131r. Annesiyle beraber cezaevinde kalan \u00e7ocuk say\u0131s\u0131 48, sair adli su\u00e7lardan 330\u2019dur. PKK ter\u00f6r \u00f6rg\u00fct\u00fc mensubu 7092 ki\u015fi bu g\u00fcn itibariyle cezaevlerinde bulunmaktad\u0131r.<\/p>\n\n\n\n<p>Bilindi\u011fi gibi ByLock, ter\u00f6r \u00f6rg\u00fct\u00fcn\u00fcn haberle\u015fme arac\u0131d\u0131r. \u00d6rg\u00fct \u00fcyeli\u011finin somut delilidir. Y\u00fcz bine yak\u0131n ByLock kullan\u0131c\u0131s\u0131 tespit edilmi\u015ftir.<\/p>\n\n\n\n<p>CHP Genel Ba\u015fkan\u0131 Say\u0131n Kemal K\u0131l\u0131\u00e7daro\u011flu, listesinin kendisinde bulundu\u011funu s\u00f6yledi\u011fi,<\/p>\n\n\n\n<p>120 &#8211; 160 aras\u0131nda milletvekillerinin listesini Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131na teslim ederse \u00f6rg\u00fcte bir b\u00fcy\u00fck darbe daha vurulacakt\u0131r.<\/p>\n\n\n\n<p>Bu m\u00fccadele yap\u0131l\u0131rken,Ter\u00f6r \u00f6rg\u00fctlerinin ve T\u00fcrkiye d\u00fc\u015fmanlar\u0131n\u0131n lobi faaliyetleriyle, yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na ili\u015fkin endeks puan\u0131, Afrika\u2019n\u0131n ortas\u0131ndaki Kabile devletlerinden bile d\u00fc\u015f\u00fck g\u00f6steriliyor. Bu d\u00fczmece belgeleri kimlerin haz\u0131rlad\u0131\u011f\u0131n\u0131 biliyoruz. Bu pa\u00e7avralar baz\u0131 mandac\u0131lar ve yerli i\u015fbirlik\u00e7ileri taraf\u0131ndan da hararetle destekleniyor.<\/p>\n\n\n\n<p>Kuvvetler ayr\u0131l\u0131\u011f\u0131 ilkesi \u00e7e\u015fitli \u015fekillerde zedelenebilir. Bunlardan biri de \u201cyarg\u0131sal aktivizmdir.\u201d Yarg\u0131sal aktivizm, bazen, yasama organ\u0131n\u0131n etkisizle\u015fmesine, bazen, yasama kararlar\u0131n\u0131n iptaline, bazen, yarg\u0131n\u0131n, yasama organ\u0131n\u0131n yerine ge\u00e7mesi olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Elbette yarg\u0131sal aktivizm, yarg\u0131 yetkisinin k\u00f6t\u00fcye kullan\u0131lmas\u0131 ile bir de\u011fildir. Ancak Anayasa Mahkemesinin baz\u0131 kararlar\u0131yla, \u00fcyelerinin baz\u0131 eylemleriyle g\u00fcncel siyasete taraf oldu\u011fu bilinen bir husustur.<\/p>\n\n\n\n<p>Demokrasi; millet egemenli\u011fine dayanan bir sistemdir. Vatanda\u015fl\u0131k; birey ile devlet aras\u0131ndaki hukuki ba\u011f\u0131 ifade eden siyasal bir aidiyet bi\u00e7imidir. Mahkeme kararlar\u0131 bu ba\u011f\u0131 bozmamal\u0131d\u0131r.<\/p>\n\n\n\n<p>Anayasa Mahkemesi, milletin se\u00e7tiklerinin kararlar\u0131na kar\u015f\u0131 devaml\u0131 surette karar al\u0131yorsa, orada, millet egemenli\u011finden \u00e7ok yarg\u0131\u00e7lar y\u00f6netimi h\u00e2kimdir. T\u00fcrban ve 367 kararlar\u0131nda oldu\u011fu gibi. Anayasa Mahkemesi \u00f6n\u00fcne gelen konularda yetkisini olduk\u00e7a geni\u015f tutmaya \u00e7al\u0131\u015fmaktad\u0131r. Esasen mahkemenin, hukuk kural\u0131 koyma konusunda teorik olarak demokratik me\u015fruiyeti yoktur. Mahkemenin ideolojik kararlar\u0131na kar\u015f\u0131 kontrol mekanizmas\u0131 bulunmamas\u0131 \u00f6nemli bir eksikliktir.<\/p>\n\n\n\n<p>Hukuk normu koyman\u0131n, muhakeme meselesi de\u011fil irade ve iktidar meselesi oldu\u011fu unutulmamal\u0131d\u0131r. Hukuk normu koyma iradesi, Anayasa Mahkemesi \u00fcyelerinin de\u011fil milletin se\u00e7ilmi\u015f temsilcilerine aittir.<\/p>\n\n\n\n<p>Anayasa Mahkemesi,&nbsp; baz\u0131 kararlar\u0131yla se\u00e7ilmi\u015f organlar \u00fczerinde tahakk\u00fcm kuran \u201ck\u00fcrs\u00fcden yasa yapan\u201d mahkeme konumuna d\u00fc\u015fmektedir. Anayasan\u0131n ge\u00e7ici 20. maddesi ile ilgili yorumu bunun en a\u00e7\u0131k uygulamas\u0131 olmu\u015ftur. Anayasa Mahkemesi ihlalin yap\u0131sal bir sorundan kaynakland\u0131\u011f\u0131n\u0131 tespit ederse, T\u00fcrkiye B\u00fcy\u00fck Millet Meclisi\u2019ne do\u011frudan \u00e7a\u011fr\u0131da bulunarak ihlale sebep kanunun de\u011fi\u015ftirilmesi ve gere\u011finin yap\u0131lmas\u0131 i\u00e7in T\u00fcrkiye B\u00fcy\u00fck Millet Meclisine karar\u0131n suretini g\u00f6nderebilir. Yetki bununla s\u0131n\u0131rl\u0131d\u0131r. Yarg\u0131 organ\u0131 ile demokrasi aras\u0131ndaki bu \u00e7at\u0131\u015fma sadece bizim \u00fclkemizde g\u00f6r\u00fclen bir sorun de\u011fildir.<\/p>\n\n\n\n<p>Anayasa Mahkemesi kararlar\u0131 gerek\u00e7esi hari\u00e7 ba\u011flay\u0131c\u0131d\u0131r. Kanun koyucunun iradesine ayk\u0131r\u0131 \u015fekilde yorum yoluyla karar kurulamaz. \u00d6zellikle tutukluluk haline ili\u015fkin de\u011ferlendirme yaparken a\u00e7\u0131k\u00e7a delil takdirine giderek, delil de\u011ferlendirme yasa\u011f\u0131n\u0131 \u00e7i\u011fniyor. Zaman zaman politik safla\u015fmalar\u0131n bir par\u00e7as\u0131 haline geliyor. Anayasa Mahkemesinin \u2018\u2019tutukluluk i\u00e7in gerekli gerek\u00e7e yok\u2019\u2019 dedi\u011fi baz\u0131 durumlarda Yarg\u0131tay, a\u00e7\u0131k\u00e7a mahk\u00fbmiyet i\u00e7in yeterli delil oldu\u011funa h\u00fckmediyor.<\/p>\n\n\n\n<p>Anayasa Mahkemesi, CHP&#8217;nin 15 Temmuz hain darbe giri\u015fiminin ard\u0131ndan \u00e7\u0131kart\u0131lan 8 Kas\u0131m 2016 tarihli 6755 say\u0131l\u0131 OHAL yasas\u0131n\u0131n baz\u0131 maddelerinin iptali istemini karara ba\u011flad\u0131. Bu kararda: 15 Temmuz hain darbe te\u015febb\u00fcs\u00fcn\u00fcn bast\u0131r\u0131lmas\u0131, adli ve idari \u00f6nlemler ile kanun h\u00fckm\u00fcnde kararname kapsam\u0131nda karar alan ve g\u00f6revlerini yerine getiren kamu g\u00f6revlilerinin hukuki, idari, mali ve cezai sorumlulu\u011funun oldu\u011funa h\u00fckmetti. 15 Temmuz hain darbe giri\u015fiminin ard\u0131ndan FET\u00d6 ile m\u00fccadelede \u00f6nemli kararlara imza atan kamu g\u00f6revlilerine tazminat ve r\u00fccu davalar\u0131n\u0131n a\u00e7\u0131lmas\u0131n\u0131n yolu a\u00e7\u0131ld\u0131.<\/p>\n\n\n\n<p>Bireysel ba\u015fvuru ile ihlal edilen hakk\u0131n onar\u0131lmas\u0131 ve gerekli \u00f6nlemlerin al\u0131nmas\u0131 i\u00e7in Anayasa Mahkemesi&#8217;ne verilen yetki, mahkeme kararlar\u0131na y\u00f6nelik bir denetim mekanizmas\u0131 de\u011fildir. Anayasa Mahkemesine 23 Eyl\u00fcl 2012 \u2013 30 Eyl\u00fcl 2021 tarihleri aras\u0131nda toplam bireysel ba\u015fvuru say\u0131s\u0131 335 bin 324 \u2018t\u00fcr. Sonu\u00e7land\u0131r\u0131lan ba\u015fvuru say\u0131s\u0131 ise 276 bin 307\u2019dir. Matematik problemleri ayn\u0131 \u015fekilde \u00e7\u00f6z\u00fcl\u00fcr ve ayn\u0131 sonu\u00e7 al\u0131n\u0131r. Matematikte oldu\u011fu gibi hukuk ilkeleri de a\u00e7\u0131k olmal\u0131, benzer davalarda sonu\u00e7lar ayn\u0131 olmal\u0131d\u0131r. &nbsp;<\/p>\n\n\n\n<p>Bireysel ba\u015fvurularda, ba\u015fvurucunun unvan\u0131na g\u00f6re davan\u0131n \u00f6ncelikle ele al\u0131narak sonu\u00e7land\u0131r\u0131ld\u0131\u011f\u0131 yak\u0131nmalar\u0131n\u0131 hepimiz duyuyoruz. Yine, Anayasa Mahkemesi\u2019nin bireysel ba\u015fvuruda 30 g\u00fcnl\u00fck ba\u015fvuru s\u00fcresini evrak\u0131n UYAP\u2019tan a\u00e7\u0131ld\u0131\u011f\u0131 tarihten itibaren ba\u015flatt\u0131\u011f\u0131 bilinmektedir. Bu s\u00fcrenin kat\u0131 yorumlanmas\u0131 ma\u011fduriyetlere sebep olmakta, Anayasa Mahkemesi\u2019ne eri\u015fim hakk\u0131n\u0131 ihlal etmektedir.<\/p>\n\n\n\n<p>Anayasa Mahkemesi bir ba\u015fka karar\u0131nda, kimi haber sitesi ve sosyal medya platformlar\u0131na sulh ceza hakimlerince verilen eri\u015fim engeli kararlar\u0131n\u0131n pilot karar usul\u00fcn\u00fc kullanarak; \u201cifade ve bas\u0131n \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ihlal etti\u011fi gerek\u00e7esiyle, yasada bir y\u0131l i\u00e7inde de\u011fi\u015fiklik yap\u0131lmas\u0131 i\u00e7in Meclis ve Adalet Bakanl\u0131\u011f\u0131na g\u00f6nderdi. Ger\u00e7ek d\u0131\u015f\u0131 bir haber y\u0131llar sonra engellenirse bunun kamu yarar\u0131 ve genel ahlak\u0131, ki\u015fi onurunu koruyucu yan\u0131 kal\u0131r m\u0131\u2026?<\/p>\n\n\n\n<p>Bir hukuk\u00e7unun dile getirdi\u011fi gibi, Anayasa Mahkemesi, \u00f6zelle\u015ftirme kararlar\u0131nda ekonomist, Siyasi Parti kapatma davalar\u0131nda siyaset bilimci, Laiklik kararlar\u0131nda din uzman\u0131 gibi kendine g\u00f6re tespitlerde bulunup karar verebilmi\u015ftir.<\/p>\n\n\n\n<p>Mahkemeler, T\u00fcrk Milletinin hukukunu, vatanda\u015f\u0131n hakk\u0131n\u0131 korurken politik r\u00fczg\u00e2rlar\u0131n tesirinden uzak durmal\u0131d\u0131r. Anayasa Mahkemesi\u2019nin bu kadar \u00e7ok farkl\u0131 konulardaki davalara bakmas\u0131 do\u011fru de\u011fildir.<\/p>\n\n\n\n<p>T\u00fcrkiye, 1954\u2019den beri Avrupa \u0130nsan Haklar\u0131 S\u00f6zle\u015fmesine taraft\u0131r. 1987 y\u0131l\u0131ndan itibaren Avrupa \u0130nsan Haklar\u0131 Mahkemesinin yarg\u0131 yetkisine d\u00e2hil olmu\u015ftur. Ancak; Avrupa \u0130nsan Haklar\u0131 Mahkemesinin de kararlar\u0131nda bir standart yoktur.&nbsp;<\/p>\n\n\n\n<p>T\u00fcrkiye\u2019mizin yeni, sivil, nitelikli, geni\u015f kat\u0131l\u0131ml\u0131, milli ve manevi hayat\u0131m\u0131z\u0131n esaslar\u0131n\u0131 kavram\u0131\u015f, gerek\u00e7eleriyle ger\u00e7ekleri yakalam\u0131\u015f bir Anayasaya ihtiyac\u0131 vard\u0131r. 1982 Anayasas\u0131nda 19 defa, toplam 184 de\u011fi\u015fiklik yap\u0131lm\u0131\u015f, sistemati\u011fi tamamen bozulmu\u015ftur.<\/p>\n\n\n\n<p>Milliyet\u00e7i Hareket Partisi\u2019nin haz\u0131rlad\u0131\u011f\u0131 Anayasa teklifinin bir b\u00f6l\u00fcm\u00fcn\u00fc sizlerle payla\u015fmak istiyorum. Anayasa \u00f6nerimiz; Ba\u015flang\u0131\u00e7,<\/p>\n\n\n\n<p>Genel Esaslar, Temel Hak ve \u00d6devler, Cumhuriyetin Temel Organlar\u0131<\/p>\n\n\n\n<p>Son H\u00fck\u00fcmler \u015feklinde d\u00f6rt k\u0131s\u0131m ve 100 maddeden olu\u015fmaktad\u0131r.&nbsp;<\/p>\n\n\n\n<p>Ba\u015flang\u0131ca, \u201cAllah\u2019\u0131n l\u00fctfu, karde\u015flik ruhu ve vatan sevgisiyle varl\u0131k bulmu\u015f biz T\u00fcrk Milleti\u201d d\u00fcsturu ile giri\u015f yap\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>\u201cDevletin \u015fekli ve nitelikleri\u201d aynen korunarak birinci maddede ele al\u0131nm\u0131\u015f, maddenin son f\u0131kras\u0131nda \u201cBu madde de\u011fi\u015ftirilemez ve de\u011fi\u015ftirilmesi teklif edilemez\u201d h\u00fckm\u00fc konulmu\u015ftur. Anayasa\u2019n\u0131n ikinci k\u0131sm\u0131nda \u201cTemel Hak ve \u00d6devler\u201d d\u00fczenlenmi\u015f, &nbsp;en geni\u015f \u015fekilde g\u00fcvenceye kavu\u015fturulmu\u015ftur. Haklar\u0131 d\u00fczenleyen t\u00fcm maddelerdeki s\u0131n\u0131rlama sebepleri kald\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Temel hak ve h\u00fcrriyetlerin kapsam\u0131, taraf oldu\u011fumuz insan haklar\u0131 s\u00f6zle\u015fmeleri baz al\u0131narak kanunla belirlenmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015f,<\/p>\n\n\n\n<p>H\u00fcrriyetin esas, s\u0131n\u0131rlaman\u0131n istisna oldu\u011fu yakla\u015f\u0131m\u0131 ger\u00e7ek anlam\u0131yla bulu\u015fturulmu\u015ftur.<\/p>\n\n\n\n<p>Anayasa\u2019n\u0131n \u00fc\u00e7\u00fcnc\u00fc k\u0131sm\u0131nda, \u00fc\u00e7 b\u00f6l\u00fcm halinde \u201cCumhuriyetin Temel Organlar\u0131\u201d, yasama, y\u00fcr\u00fctme ve yarg\u0131 ba\u015fl\u0131klar\u0131 ile d\u00fczenlenmi\u015f, yasama organ\u0131 i\u00e7in \u201cMilli birli\u011fi sa\u011flama\u201d, y\u00fcr\u00fctme i\u00e7in \u201cKurumsalla\u015fm\u0131\u015f ba\u015fkanl\u0131k sistemi\u201d, &nbsp;yarg\u0131 i\u00e7in \u201cBa\u011f\u0131ms\u0131z ve tarafs\u0131z yap\u0131lanma\u201d anlay\u0131\u015f\u0131 \u00f6n plana \u00e7\u0131kar\u0131lm\u0131\u015ft\u0131r.&nbsp;<\/p>\n\n\n\n<p>Bu kapsamda TBMM Ba\u015fkan\u0131\u2019na \u201cTarafs\u0131z konumuyla\u201d milli uzla\u015fman\u0131n sa\u011flanmas\u0131nda ve siyasi krizlerin \u00e7\u00f6z\u00fcm\u00fcnde arabuluculuk i\u015flevi y\u00fcklenmi\u015ftir. TBMM\u2019nin yetkileri; kanun yap\u0131m\u0131nda, &nbsp;antla\u015fmalar\u0131n onaylanmas\u0131nda ve sona erdirilmesinde, b\u00fct\u00e7enin kabul edilmesinde, anayasal kurum ve kurulu\u015flara \u00fcye se\u00e7mede, meclis soru\u015fturmas\u0131 a\u00e7\u0131lmas\u0131nda kuvvetlendirilmi\u015ftir. Ba\u015fkanl\u0131k Sistemi, yeni anayasa b\u00fct\u00fcnl\u00fc\u011f\u00fc i\u00e7inde \u201ckurumsal yap\u0131ya\u201d kavu\u015fturulmu\u015f, Ba\u015fkan ile birlikte iki Ba\u015fkan Yard\u0131mc\u0131s\u0131n\u0131n se\u00e7ilmesi \u00f6ng\u00f6r\u00fclm\u00fc\u015f, Ba\u015fkanl\u0131k Kabinesi anayasal stat\u00fcye dahil edilmi\u015ftir.<\/p>\n\n\n\n<p>Ba\u015fkanl\u0131k H\u00fck\u00fcmet Program\u0131\u2019n\u0131n Meclise sunulmas\u0131 y\u00f6ntemi getirilmi\u015f, Ba\u015fkanl\u0131k Kararnameleri ile kanunlar\u0131n m\u00fcnhas\u0131r yetki alanlar\u0131 \u00e7at\u0131\u015fmayacak \u015fekilde belirlenmi\u015ftir. T\u00fcrkiye\u2019nin \u00fcniter yap\u0131s\u0131na uygun olarak, idarenin kurulu\u015funda \u201ckanunilik ilkesi\u201d sa\u011flam ve sa\u011fl\u0131kl\u0131 bir i\u00e7eri\u011fe ta\u015f\u0131nm\u0131\u015ft\u0131r. \u00dcniter devlet ilkesine anayasada a\u00e7\u0131k\u00e7a yer verilerek, idari yap\u0131lanmada \u201cil esas\u0131\u201d korunmu\u015ftur.<\/p>\n\n\n\n<p>Anayasal kurumlardan Atat\u00fcrk, K\u00fclt\u00fcr, Dil ve Tarih Kurumu varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcrm\u00fc\u015f, Diyanet \u0130\u015fleri Ba\u015fkanl\u0131\u011f\u0131 \u201cT\u00fcrkiye Diyanet Kurumu\u201d olarak yeniden yap\u0131land\u0131r\u0131lm\u0131\u015f, Y\u00fcksek\u00f6\u011fretim Kurulu\u2019nun olu\u015fumunda TBMM\u2019nin yetkileri art\u0131r\u0131lm\u0131\u015f, yeni bir kurum olarak \u201cT\u00fcrkiye Liyakat Kurumu\u201d \u00f6nerilmi\u015f ve T\u00fcrkiye Merkez Bankas\u0131 anayasal kurulu\u015f haline getirilmi\u015ftir.<\/p>\n\n\n\n<p>Yarg\u0131 organ\u0131n\u0131n yap\u0131lanmas\u0131nda, \u201cYarg\u0131 ayr\u0131l\u0131\u011f\u0131 sistemi\u201d devam ettirilmi\u015f, Hakimler ve Savc\u0131lar Kurulu, \u201cYarg\u0131 Y\u00fcksek Kurulu\u201d ad\u0131yla yeniden ele al\u0131nm\u0131\u015f, Avukatl\u0131k ve arabuluculuk mesleklerine anayasal stat\u00fc tan\u0131nm\u0131\u015f, Anayasa Mahkemesi y\u00fcksek mahkeme de\u011fil, \u00f6zel bir stat\u00fcde d\u00fczenlenmi\u015f, Y\u00fcce Divan yarg\u0131lamas\u0131 ve siyasi parti kapatma davalar\u0131 \u201cY\u00fcce Divan\u201d ad\u0131yla olu\u015fturulan yeni bir mahkemeye verilmi\u015ftir.<\/p>\n\n\n\n<p>Y\u00fcksek Mahkemeler ba\u015fl\u0131\u011f\u0131 alt\u0131nda Say\u0131\u015ftay ve Y\u00fcksek Se\u00e7im Kurulu\u2019nun stat\u00fcs\u00fc a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmu\u015f, yarg\u0131ya ili\u015fkin \u00fcye se\u00e7iminde TBMM\u2019nin yetkileri geni\u015fletilmi\u015ftir, Osmanl\u0131-T\u00fcrk Anayasac\u0131l\u0131\u011f\u0131nda, parlamenter sistem, y\u00fcz y\u0131l\u0131 a\u015fk\u0131n bir s\u00fcre uygulanm\u0131\u015f, ancak T\u00fcrkiye\u2019de ba\u015far\u0131l\u0131 sonu\u00e7lar vermemi\u015ftir.<\/p>\n\n\n\n<p>T\u00fcrk milletinin beklentisi, Cumhuriyetin 100. y\u0131l\u0131nda \u201cParlamenter sistemle geriye gidi\u015f\u201d de\u011fil, gelecek y\u00fczy\u0131l\u0131 milli ve vizyoner bir bak\u0131\u015fla kavrayan \u201cT\u00fcrk Tipi Ba\u015fkanl\u0131k Sistemi\u2019nin k\u00f6kle\u015fmesi, bunun yan\u0131 s\u0131ra huzuru, refah\u0131, birlik ve karde\u015flik ba\u011flar\u0131n\u0131 tahkim edecek yeni bir anayasad\u0131r.<\/p>\n\n\n\n<p>Sosyal medya, ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc i\u00e7in \u00f6nemli bir aland\u0131r. Ancak, bir hakk\u0131n teslimi i\u00e7in, hakikati bulmak i\u00e7in insan haysiyeti i\u00e7in, adil ve yasal olan\u0131 korumak i\u00e7in ahlaki bir erdem olan adaletin sosyal medya \u00fczerinden aranmas\u0131 yarg\u0131y\u0131 olumsuz etkilemektedir. Masumiyet karinesi ve adil yarg\u0131lanma hakk\u0131 zarar g\u00f6rmektedir. Bu mecralarda Polis ve mahkemelere yol g\u00f6sterilmekte, kampanyalar d\u00fczenlenmektedir. Hatta tehditk\u00e2r bir dille tutuklama ya da serbest b\u0131rakmalar bile talep edilmektedir.<\/p>\n\n\n\n<p>Son y\u0131llarda toplumsal \u015fiddet ve tahamm\u00fcls\u00fczl\u00fck giderek art\u0131yor, \u00e7ok say\u0131da kad\u0131n ve \u00e7ocuk vah\u015fice \u00f6ld\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fc g\u00f6r\u00fcyoruz. Kad\u0131n cinayetleri, cinsiyet belirtmenin \u00f6tesinde insanl\u0131\u011f\u0131 \u00f6ld\u00fcren bir vak\u0131ad\u0131r. Bu olaylarda genel olarak su\u00e7 failler tan\u0131d\u0131k olup \u00e7o\u011funlukta koca ya da eski kocad\u0131r. &nbsp;<\/p>\n\n\n\n<p>Tecav\u00fczden sonra \u00f6ld\u00fcrmelerde ise cani genellikle ba\u015fkalar\u0131d\u0131r. \u0130ki hafta \u00f6nce Mimar Ba\u015fak Cengiz\u2019in hi\u00e7 tan\u0131mad\u0131\u011f\u0131 bir cani taraf\u0131ndan sokak ortas\u0131nda samuray k\u0131l\u0131c\u0131 ile vah\u015fice \u00f6ld\u00fcr\u00fclmesi ve cinayetin ard\u0131ndan vermi\u015f oldu\u011fu kan donduran ifadesi toplumu derinden sarsm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Milliyet\u00e7i Hareket Partisi\u2019nin haz\u0131rlay\u0131p sundu\u011fu, Ruh Sa\u011fl\u0131\u011f\u0131 Kanun teklifi Sa\u011fl\u0131k Komisyonunda beklemektedir. Bu yasa ile; ruh sa\u011fl\u0131\u011f\u0131 alan\u0131nda geli\u015fimi koruyucu, destekleyici, \u00f6nleyici, tedavi edici, iyile\u015ftirici hizmetlerin, e\u011fitim ve sosyal desteklerin usul ve esaslar\u0131 ile ilgili kurulu\u015f ve bakanl\u0131klar\u0131n yetki ve sorumluluklar\u0131 belirlenmektedir. Bir an \u00f6nce komisyonda g\u00f6r\u00fc\u015f\u00fclerek Genel Kurula getirilmelidir.<\/p>\n\n\n\n<p>5275 say\u0131l\u0131 Kanun&#8217;un ge\u00e7ici 9. maddesi kapsam\u0131nda, 14 Nisan 2020&#8217;den itibaren, a\u00e7\u0131k ceza infaz kurumlar\u0131nda bulunanlar ile kapal\u0131 ceza infaz kurumunda bulunup da a\u00e7\u0131k ceza infaz kurumlar\u0131na ayr\u0131lmaya hak kazanan h\u00fck\u00fcml\u00fcler ve denetimli serbestlik tedbiri uygulanarak, Kovid-19 iznine g\u00f6nderildi.<\/p>\n\n\n\n<p>S\u00f6z konusu h\u00fck\u00fcml\u00fclerin izin s\u00fcreleri, yasa gere\u011fi 30 Kas\u0131m&#8217;dan itibaren 6 ay daha uzat\u0131lacakt\u0131r. Bu h\u00fck\u00fcml\u00fclerin izin s\u00fcresi infazdan say\u0131lmaktad\u0131r. Ayn\u0131 hukuksal durumda olan ki\u015filerin ayn\u0131 kurallara ba\u011fl\u0131 tutulmas\u0131 e\u015fitlik ilkesinin gere\u011fidir. Ayn\u0131 su\u00e7 tipinden kapal\u0131 Cezaevinde bulunanlar\u0131n da infaz\u0131ndan izin s\u00fcresi kadar d\u00fc\u015f\u00fcm yap\u0131lmas\u0131 adaletin gere\u011fidir.<\/p>\n\n\n\n<p>\u0130nsan iradesinin arkas\u0131nda \u00e7e\u015fitli etkiler vard\u0131r.
